Palm Oil Companies in Sorong Must Return Land to Local Government, After Lawsuit Rejected by PTUN

InfoSAWIT, SORONG – The attorney of District of Sorong, Piter Ell mentioned that Jayapura Administrative Court refused the claims of palm oil plantation companies - PT Papua Lestari Abadi and PT Sorong Agro Sawitindo against to District of Sorong.

“If there is no appeal, 55.631 hectares area will be belonging to District of Sorong and the indigenous people,” Piter Ell said in zoom press conference, Tuesday (7/12/2021).

Piter read the sentence of the case Number 31/G/2021/PTUN.JPR for the claim of PT Inti Kebun Lestari and PT Papua Lestari Abadi on the case Number 32/G/2021/PTUN.JPR.

"Sentence to refuse every claim of litigant to the first case, which is, Decision of Regent of Sorong Number 525/KEP.58/IV/ 2021 about Revocation of Decision of Regent of Sorong Number 163 / 2011 about Location Permit to Palm oil Plantation Business to PT Papua Lestari Abadi in Village of Waimun, Distrik Segun, District of Sorong," Piter said.

Administrative Court’s judge did the same sentence to the claim by PT Sorong Agro Sawitindo with Case Number 31/G/2021/PTUN.JPR. In his sentence, the judge did not take every claim of litigant to second case, which is, Decision of Regent of Sorong Number 525/Kep.61/IV/2021 about Revocation of Regent of Sorong Number 42/185 / 2013 about location license renewable to palm oil plantation business to PT Sorong Agro Sawitindo in Distrik Segun, Klawak and Klamono, District of Sorong. The claim was titled on 27 April 2021.

District of Sorong’s attorney Nur Amaliah said, the total areas could be laying about 105 thousand hectares. But two cases with Number 29/G/2021/PTUN.JPR and Number 30/G/2021/PTUN.JPR are not sentenced yet.

The cases were claimed by PT Inti Kebun Lestari in Distrik Salawati, Klamono, and Segun which covered 34.400 hectares. But now 55.631 hectares within details, 15.631 hectares belong to PT Papua Lestari Abadi in Distrik Segun and 40.000 hectares belong to PT Sorong Agro Sawitindo in Segun, Kwalak, and Klamono should be handed over to the district and indigenous people.

“The total areas of three companies cover more than 150 thousand hectares but we do not know yet about cases number 29 and 30. We hope, this will be Christmas gifts for them and we will be giving back about 105 thousand hectares to the district and indigenous people,” Amaliah said.

Amaliah continued, Regent of Sorong, Johny Kamuru and indigenous people will discuss about land use after the sentence. If the companies appeal, the district and indigenous people will wait for the inkracht.

“Willing or not, the 105 thousand - hectare areas are in status quo until we get inhracht then regent and indigenous people will follow up the areas,” she said. (T2)
