InfoSAWIT, JAKARTA — After a lengthy and complex trial process, the Jakarta Administrative Court (PTUN) has dismissed the lawsuit filed by Duta Palma Group against several government agencies and PT Agrinas Palma Nusantara (Persero). This ruling reaffirms Agrinas' legal position as the legitimate manager of state assets currently under legal seizure.
The verdict was announced on Wednesday, July 2, 2025, during a virtual session led by Chief Judge Oenoen Pratiwi, S.H., M.H. The court stated that it lacked jurisdiction over the disputed object.
According to InfoSAWIT, as reported on Agrinas' official website on Saturday (July 5, 2025), the court determined that the subject of the lawsuit was not merely an administrative action but part of judicial actions taken by investigating prosecutors. This included the seizure of assets, which were subsequently entrusted to a third party, namely PT Agrinas Palma Nusantara (Persero), accompanied by an official report.
"Although the report is administratively textual, it substantively represents a continuation of a legitimate legal process in the investigation of criminal acts, in accordance with the provisions of the Criminal Procedure Code," the court's legal considerations stated.
As is known, Agrinas was appointed by the state to manage assets derived from the seizure related to the Duta Palma Group case. These assets were entrusted by the Attorney General's Office while still undergoing legal processes. This assignment is temporary but crucial to prevent damage, depreciation of asset value, and increased maintenance costs if left unattended.
PT Agrinas Palma Nusantara (Persero) welcomed the court's decision. Through its Legal Division Head, Brigadier General (Ret.) I Nyoman Suparta, S.H., M.H., who represented the company in the previous trial on June 18, 2025, Agrinas emphasized that all asset management actions were conducted in accordance with legal regulations.
This ruling also represents a positive development for PT Agrinas Palma Nusantara's transformation efforts as a state-owned enterprise (BUMN) in the agribusiness sector, which is being developed into a national holding company. The clarity of the legal status of the managed assets is a vital foundation for the sustainability of operations and the achievement of the company's transformation targets.
