Here Are the Obstacles in Indigenous People and Region Recognation

InfoSAWIT, JAKARAT –There are some challenges for many parties to encourage/empower the recognation of indigenous people and regions, such as, the first, it would take some time and expensive cost to publish a regional regulation. One regional regulation would, at least, take one to two years. It sometimes would be longer. It would spend at least, Rp 700 million to Rp one billion per year.

Meanwhile the substance of the regional regulation is mostly regulating the ways to admit indigenous people. It means, there would be derivative regulations that needs regional heads to conduct everything. If there is no derivative regulations, the regional regulation would stop and cannot be available.

The second, there are few regional heads which are in charge and lead to implement indigenous people recognation. This delivered that there are not many regional organizations/institutions that should be having special tasks. They even have no available budget to identify and verify the existence of indigenous people and regions.

The third, the unqualified institutions and staffs to conduct technical event to arrange the guidelines and every phase to indigenous people recognation, such as, regulated in the regional policies, and other regulations. “The fourth, the low support to the indigenous people to get participative map process on the indigenous regions and qualified data preparation to qualify technical terms and conditions substantively as it is regulated in the regional regulations or other regulations,” Head of Badan Registrasi Wilayah Adat (BRWA), Kasmita Widodo said, as in the official statement to InfoSAWIT, Tuesday (9/8/2022).

In some regions, the indigenous people took the opportunity to accelerate their rights because they fulfilled the legal forms, policies, the political supports, and regional heads leadership. But what happens now is that the substitution of regional head because their time has ended. The regional heads in duty, as it is concerned, could not continue such program. Heading to political year to the general election in 2024, it is afraid that this would be stop. In the meantime, every strategic project in national scale, such as, the construction of Ibukota Nusantara (IKN), food estate, super priorty tourism industries would getting more to be realized but threaten the existence of indigenous people and regions. That is why the government and legislators need to validate the Draft of Indigenous People Regulation. The regional governments should establish and realize the policy to admit and protect indigenous people.

BRWA is a registration institution to indigenous region. It was established in 2010 for the intiative of Aliansi Masyarakat Adat Nusantara (AMAN), Jaringan Kerja Pemetaan Partisipatif (JKPP), Forest Watch Indonesia (FWI), Konsorsium Pendukung Sistem Hutan Kerakyatan (KPSHK), and Sawit Watch (SW).
